The area of energy is part of the remit of the Ministry of Industry. Energy policy is set at the national level by the following laws:

• Law No 85-48 of 25 April 1985 encouraging research into and generation and marketing of renewable energy.
• Law No 2004-72 of 2 August 2004 on energy control. Article 16 establishes a non-administrative public institution with legal personality and financial autonomy called the National agency for energy control.It is under the authority of the minister for energy.

• Decree No 2004-1025 of 26 April 2004 establishing the remit of the National agency for renewable energy.

• Law No 2005-106 of 19 December 2005 establishing the finance law for 2006. Articles 12 and 13 thereof set up a national fund for energy control.

• Law No 2005-82 of 15 August 2005 establishing a system for energy control.
