The Ministry of the Interior (Asylum Office) takes first instance decisions.

The right to asylum is enshrined in Article 57(1) of the Constitution of Serbia.

The asylum system and procedure is governed by the 2008 Asylum Act. 

The Foreigners Act and the General Administrative Procedure Act, the Migration Management Act, also regulates certain issues relevant to the housing and integration of asylum seekers and refugees.

Law on Employment of Foreigners (Official Gazette No. 128/2014 of 26 November 2014), entered into force on 4 December 2014 and the Regulations on authorized for work ( "Official Gazette RS "No. 94/2015 dated 17 November 2015), entered into force on 25 November 2015, laid down new conditions for employment of foreigners in the Republic of Serbia.
